Bedford man faces more charges for inmate assault
Fitzgerald already in jail on other felony counts
A Bedford man already in jail is now facing additional charges after allegedly attacking another inmate in the Bedford County Correctional Facility.
Bail has been denied for Chase R. Fitzgerald, 26, after the alleged assault that put the victim in the hospital.
According to the affidavit of probable cause, the assault occurred about 10:30 p.m. June 18 at the Bedford County jail when video surveillance shows Fitzgerald walking up the stairs to the second level of the jail, entering cell 8 and punching the victim, who was sleeping when the attack began.
Police said due the camera angle and other inmates standing between the camera and the assault, the number of strikes could not be accurately counted.
Video shows Fitzgerald exiting the cell and walking back down the stairs before corrections officers entered and locked down A Block, police reported.
The victim was taken to UPMC Bedford, where he was interviewed the following afternoon. The victim said a “tall blond kid” assaulted him and he was sleeping when he began to get punched in the back of the head.
The victim suffered a broken nose and fractured left orbital bone, and had bruises and bumps all over his head, the report states.
The victim was transported to Mercy Hospital in Pittsburgh due to his injuries, police said.
Fitzgerald was arraigned Monday on a felony count of aggravated assault before Magisterial District Judge Kevin R. Diehl and returned to the jail with bail denied. “Proof is evident and presumption great that no bail, or combination of bail, will ensure compliance,” the court docket states.
Fitzgerald is due for a preliminary hearing July 1 in Bedford County Central Court.
Fitzgerald has two active cases against him from Fulton County, according to online court documents.
He was arraigned in those cases on June 11. The docket for the first case states Fitzgerald is facing two felony charges of assaulting a law enforcement officer and misdemeanor charges of institutional vandalism and terroristic threats. Bail was denied in that case because “no amount can guarantee the conditions are met,” the docket states.
The docket for the second case shows that Fitzgerald was arrested on June 11 on misdemeanor charges of resisting arrest, evading arrest, retail theft and theft by unlawful taking. Bail was also denied in that case.
His preliminary hearings in Fulton County are set for Aug. 3.
