Altoona police were dispatched about 1:40 a.m. Tuesday to the 1300 block of Second Avenue after the victim called 911 from a neighbor’s home.
According to the report, Smith and the victim were arguing when Smith grabbed the woman’s throat and choked her. When the victim went to call police, Smith apologized and tried to hug her. He became angry when she told him what he did was not OK and he then hugged/picked her up and bit her under the chin, court documents state. Smith took her phone so she couldn’t call police, and the victim fled to a neighbor’s home, the report states.
Smith was located in a home on the 1300 block of Second Avenue, where it was found he had the victim’s phone, police reported. Court documents state Smith had scratches all over his body that resembled defensive marks from the victim trying to fight him off.
