BEDFORD -- A Claysburg woman jailed for reportedly killing her husband last year entered a not guilty plea Wednesday.
Nancy Lee Focht, 71, currently housed at the Bedford County Jail, is accused of fatally shooting her husband, David Glenn Focht Sr., in the chest on Sept. 11 at 206 Mountain Penny Lane.
Focht pleaded not guilty to charges of criminal homicide, two counts of aggravated assault, three counts of simple assault, a count of recklessly endangering another person and a count of tampering with and fabricating physical evidence.
Thomas Dickey, her attorney, said Focht waived her hearing Wednesday while retaining the right to question and challenge the sufficiency of evidence later down the road.
Dickey said waiving her hearing puts him in a better position to review all the evidence and conduct an in-depth investigation into Focht's case.
State police said they responded to an active domestic at the Mountain Penny Lane residence that day about 2:35 p.m. and found the victim with a gunshot wound to the right lower chest area.
Bedford County Coroner Russell Styer declared the victim dead at the residence about an hour later, according to a police criminal complaint.
Focht initially told police she and the victim had been arguing all day, which led to a struggle over the gun after the victim returned to the shed they'd been arguing in with the cocked gun, police said. During the struggle, Focht reportedly said the gun went off and struck the victim in the chest area.
Police said the ballistics analysis didn't support Focht's claim that the gun was shot at close range. When questioned by police again, Focht allegedly admitted to bringing the gun to the shed and shooting the victim.
