Spikes’ home in jeopardy after PSU civil lawsuit
UNIVERSITY PARK — The State College Spikes’ future at Medlar Field at Lubrano Park is now in question after a civil lawsuit was filed Tuesday by Penn State University against the MLB Draft League franchise.
The lawsuit alleges the Spikes have failed to properly renew their long-term operating agreement for the stadium and are currently using the ballpark — also used by the Penn State baseball team — without a valid lease.
Penn State said the team never submitted the required written notice for its second 10-year renewal of its operating agreement and that the agreement expired automatically last September.
Penn State is not only seeking possession of the stadium but also $1.7 million in “termination rent.”
Spikes chairman Chuck Greenberg, the former Altoona Curve majority owner, told the Centre Daily Times that the team “fully complied with the renewal process.” A press release issued by the Spikes on Friday said, “there is zero merit to Penn State’s lawsuit or its allegations. The Spikes are the reason Medlar Field at Lubrano Park was built, funded by Commonwealth taxpayers and the Spikes themselves.”
The case will now go to the Centre Court of Common Pleas.
