City man offered plea deal in teen sexual assault case

HOLLIDAYSBURG — A city man accused of sexually assaulting two teenage coworkers has been offered a plea deal and given until July 20 to mull it over.
Justin Tyler Nunamaker, 28, is facing single felony counts of aggravated indecent assault without consent and corruption of minors, a misdemeanor count of indecent assault without consent, two summary counts of harassment and a summary count of public drunkenness. He has been incarcerated at the Blair County Prison on $250,000 bail since his arrest on Dec. 2, 2025.
Nunamaker appeared alongside First Assistant Public Defender John Siford for a trial list review hearing in front of Judge Jackie Atherton Bernard on Monday.
During the hearing, Siford told Bernard that Nunamaker was adamant about taking the case to a jury trial and wanted to be placed on the calendar for jury selection either on June 22 or July 13.
When Bernard asked First Assistant District Attorney Nichole Smith how long she believed the trial would last, Smith said “easily three days — depending on what the defense is going to do, four days.”
Smith said the Blair County District Attorney’s Office had video of the alleged assault that the jury would need to watch and that the underage victims would need to testify.
Bernard then asked if the DA’s Office had extended a plea offer to Nunamaker, to which Smith said they had made an offer of seven- to 20-years’ incarceration.
The crimes for which Nunamaker is charged carry a mandatory minimum sentence of 10- to 20-years’ incarceration, if the defendant is found guilty, Smith said.
Siford told Bernard that Nunamaker had rejected the offer and wanted to proceed to trial.
Given the opportunity to speak on his own behalf, Nunamaker said Siford hadn’t seen him once to go over his case in the six months he’d been incarcerated. When Siford attempted to clarify the situation to Bernard, Nunamaker repeatedly spoke over him and had to be told to stop.
Bernard told Nunamaker that Siford was trying to explain how the case was not ripe for a jury trial and that, in order for him to see the evidence, Siford would need to make an appointment with the DA’s Office and have Nunamaker brought to the courthouse from the prison to attend.
Bernard said she wanted to make sure Nunamaker understood the consequences of rejecting the plea offer and proceeding to trial, especially as he had not seen all of the evidence that the prosecution possessed.
Nunamaker insisted he didn’t want to take the plea deal.
“I’m really well aware,” Nunamaker said. “I’m not going to do that.”
Bernard then asked Smith if she was willing to leave the offer on the table, to which Smith said she would leave it open for one more jury selection term.
Bernard ultimately scheduled Nunamaker for another trial list review hearing on July 20, after which the plea deal would be off the table.
Nunamaker was charged in early December 2025 after a weekslong investigation by Altoona police into allegations made by Nunamaker’s 17-year-old coworker. The victim accused Nunamaker of being intoxicated and sexually assaulting him during their shift at the Old Carolina Barbecue, the police report stated.
Nunamaker was also accused of repeatedly harassing an 18-year-old female coworker by trying to hug her during the same shift. The female victim was forced to hide in the bathroom to avoid Nunamaker, the report stated.
