Collision that sent vehicle into brew pub results in felony aggravated assault charge
Dean accused of speeding in crash that severely hurt other driver
A city man was charged with felony aggravated assault by vehicle after allegedly speeding and causing a collision that “severely” injured the driver of the other vehicle.
Dalton Lee Dean, 18, was arraigned Thursday by Magisterial District Judge Daniel C. DeAntonio. In addition to the single felony charge, Dean faces two misdemeanor counts of recklessly endangering another person and five summary traffic violations.
Dean remains free on unsecured $20,000 bail.
Altoona police were dispatched to a motor vehicle accident with entrapment along the 600 block of Seventh Avenue about 1:54 p.m. Dec. 24. On scene, officers were directed to the victim’s vehicle, which had been pushed inside the front door of the Altus Brew Pub at 601 Seventh Ave. The victim was conscious but complaining of serious pain and officers reported her as being “obviously severely injured.” The victim was subsequently extracted from the vehicle by firefighters and transported to UPMC Altoona, according to the affidavit of probable cause.
Officers then located Dean, who was sitting on the sidewalk and appeared to be bleeding from the face. He was also taken to UPMC Altoona, the police report states.
Through their investigation, officers learned that Dean was speeding along Seventh Avenue and tried to avoid colliding with the victim by swerving into the left lane. Dean struck the victim in a T-bone collision, pushing the victim’s vehicle through the pub’s front door, the report states.
Dean told officers he was driving about 40 mph when he saw the victim’s car in the intersection and tried to avoid them by swerving. Officers noted that posted speed limit signs marked the area as a 30 mph zone, the report states.
A witness told officers he was driving along Seventh Avenue when Dean passed him going about 60 mph. The witness said that when Dean got around his vehicle, it approached and overtook a second vehicle. The witness said he saw Dean was going to strike the victim and reported watching him swerve to miss the victim, but ultimately causing the crash, the report states.
A second witness reported seeing Dean driving between 60 and 80 mph and changing lanes without signaling. The witness said the victim appeared to have plenty of time to clear the intersection had it not been for Dean’s speed. The building’s owner provided officers with a video of the crash, which corroborated the witnesses’ statements, the report states.
Officers learned from the victim’s family that the victim was flown to Pittsburgh for trauma care. The victim later gave officers medical documentation showing spinal, pelvic, head and organ injuries, all of which required extensive, long-term in-patient care at multiple facilities, according to the affidavit.
Officers reported that both vehicles were totaled in the crash and that the building had sustained heavy damage requiring extensive repairs. An estimate for the total damage is pending, the report states.
Dean is scheduled for a preliminary hearing in front of DeAntonio on April 8.
