Claysburg man charged with assaulting officer during ex-wife’s arrest

A Claysburg man was taken into custody after allegedly assaulting a police officer as they were arresting his ex-wife on an active felony arrest warrant.

Frank James Nixon, 66, was arraigned Monday by Magisterial District Judge Andrew L. Blattenberger on a felony count of aggravated assault, single misdemeanor counts of obstruction of the administration of law enforcement and simple assault, as well as a single summary count of harassment. He remains free on unsecured $100,000 bail.

The charges stem from Greenfield Township police executing a felony arrest warrant for Nixon’s ex-wife Cathy Boston at a residence along the 300 block of Metzgar Lane in Claysburg about 6:38 p.m. on Monday. While police were putting Boston in handcuffs, Nixon rushed at them and grabbed Boston before shoving the officers, according to the affidavit of probable cause.

Officers told Nixon to move back and comply with their orders but Nixon failed to comply. He eventually started walking away with the assistance of Boston’s husband and complied momentarily as other officers were called to the scene. Nixon then started to exit the room and, when told by officers to return, got into a fighting stance. When officers drew their Tasers, Nixon returned to his seat, the police report states.

Officers noted Nixon became apologetic while waiting for other officers to arrive. He was then taken into custody.

Nixon is scheduled for a preliminary hearing Feb. 12 in front of Blattenberger.

Claysburg resident Cathy A. Boston, 70, is facing single felony counts of burglary, arson – inhabited building or structure, reckless burning or exploding and criminal trespass, as well as a misdemeanor count of recklessly endangering another person. While her case is inactive, she remains free on unsecured $200,000 bail.
