New York man allegedly threatened to kill other man with sword

A New York man residing in Altoona was taken into custody after threatening to kill another man with a sword when he was told to leave the residence.

Jorge Luis Rodriguez, 45, was arraigned Wednesday by Magisterial District Judge Andrew L. Blattenberger on single misdemeanor counts of simple assault and making terroristic threats. He was remanded to the Blair County Prison in lieu of $100,000 bail.

Altoona police were dispatched about 9:23 p.m. Tuesday to a residence along the 300 block of Cherry Avenue for a report of a physical domestic. Officers could hear Rodriguez and the victim yelling at each other from inside the building. When officers knocked on the door, Rodriguez ran out of the house and told officers “I’m the victim, look at my face,” according to the affidavit of probable cause.

The victim told officers that her son was upstairs while she was arguing with Rodriguez and heard the fight. Her son came downstairs to find out what was going on and he and the victim told Rodriguez he needed to leave, but Rodriguez refused, the police report states.

Rodriguez then went upstairs before returning with the victim’s gun. The victim and her son managed to take the gun from Rodriguez, who then grabbed a sword from the home’s dining room. He pointed the sword at the victim’s son and said “I’m going to kill you.” Rodriguez then threw the sword before starting to record on his phone, the report states.

Officers interviewed Rodriguez and reported his statements as being vague, short and inconsistent. When they viewed Rodriguez’s recording, they saw it corroborated the victim’s version of events, according to the affidavit.

Rodriguez is scheduled for a preliminary hearing in front of Magisterial District Judge Daniel C. DeAntonio on Feb. 18.
