Altoona pair accused in drug delivery overdose death
Lestochi, Lear allegedly provided heroin that led to Roscia’s death
An Altoona couple is accused of delivering the drugs that resulted in the overdose death of 47-year-old Matthew Roscia in early November.
Stefanie Marie Lestochi, 45, was arraigned Wednesday by Magisterial District Judge Matthew Dunio on single felony counts of conspiracy – drug delivery resulting in death and conspiracy – possession with intent to deliver, two misdemeanor counts of conspiracy – recklessly endangering another person and a misdemeanor count of conspiracy – possession of a controlled substance. She remains free on $400,000 unsecured bail.
While Martin L. Lear Jr., 45, has not been arraigned, he faces single felony counts of conspiracy – drug delivery resulting in death and conspiracy – criminal use of a communication facility, two misdemeanor counts of recklessly endangering another person, a misdemeanor count of conspiracy – possession of a controlled substance, as well as two ungraded counts of conspiracy – possession with intent to deliver.
The charges stem from a monthslong investigation by Logan Township police into an overdose death in a residence along the 1600 block of Saint Francis Lane on Nov. 6. The caller told Blair 911 that an individual, later identified as Roscia, was overdosing and “turning blue,” according to the affidavit of probable cause.
Officers found Roscia unresponsive and emergency services confirmed no signs of life with a cardiac monitor. A witness told officers Roscia had used two stamp bags of heroin and that she had last seen him alive about an hour earlier. She reported giving Roscia two doses of Narcan, the police report states.
Officers documented items of suspected drug use in plain throughout the home, including both sealed and opened stamp bags, burnt foil and mini zip-top bags scattered on the floor and bed, the report states.
In an interview, the witness told officers an individual she called “Lance” was the person who sold the drugs to Roscia and subsequently placed the 911 call. She said Lance then fled prior to officers’ arrival and took Roscia’s phone to conceal evidence. Further investigation revealed that Lance had been incarcerated in Allegheny County since Nov. 2. When confronted with this, the witness stopped answering officers’ questions, the report states.
A search warrant executed on the witness’s cellphone showed that about 1,999 phone calls, 17 FaceTime calls, 1,136 text messages and 43 contacts were deleted prior to it being taken into evidence. Of those deleted calls, about 14 were placed between the witness and Lear beginning about 8:50 a.m. Nov. 5 and ending about 5:08 a.m. Nov. 6. Deleted text messages showed the witness arranging the purchase of about 20 packets of heroin from a number believed to belong to Lestochi, the report states.
In a second interview, the witness told officers she and Roscia had been using heroin for about two years and that she had contacted Lestochi to buy 30 bags of heroin for $175 on Nov. 5. Lestotchi then arrived at her residence with Lear about 9 p.m., the report states.
When asked about Lear’s demeanor after Roscia overdosed, the witness said Lear told her to “keep his name out of her mouth.” The witness admitted to lying to officers out of fear of retaliation from the couple, the report states.
The witness told officers Roscia began overdosing about midnight and that several hours passed before 911 was called. Prior to the call being placed, Lear and two other individuals moved Roscia’s body throughout the residence as they tried to provide him with medical aid. The witness said she had assumed Roscia was still alive and didn’t know he was deceased until AMED pronounced him dead, the report states.
The witness also told police that Lear and Lestochi would rent U-Haul trucks to go on heroin and fentanyl supply runs in Pittsburgh and Philadelphia. That was then corroborated by U-Haul records and employees, who said they recovered mislaid narcotics and paraphernalia after moving vans were returned by the couple, according to the affidavit.
Lestochi is scheduled for a preliminary hearing in front of Dunio on Feb. 5.
