Another charged in alleged kidnap incident along Breezewood Road in Bedford County
Foor faces felony counts in incident that took place in Bedford County
A second person has been charged in the alleged kidnap and restraint of a woman in a garage along Breezewood Road.
Trista Dawn Foor, 35, was arraigned Wednesday by Magisterial District Judge Kayla Hetzel on single felony counts of kidnapping to inflict terror, using an incapacitation device and strangulation, as well as single misdemeanor counts of unlawful restraint, false imprisonment, simple assault and recklessly endangering another person. Unable to post $250,000 bail, she was remanded to the Bedford County Correctional Facility.
Foor’s codefendant, David Lemuel Harr, 43, was arraigned Dec. 18 on identical charges and bail.
According to the affidavit of probable cause, the victim went into an outbuilding about 5 a.m. Dec. 18 to retrieve some of her property. Harr and his girlfriend, now identified as Foor, entered the building and Harr became agitated. He slapped the victim and put her in a “sleeper hold” until she passed out, the report states.
When she regained consciousness, Harr used rope to tie her to a wooden chair and bound her hands and feet with electrical tape. The victim was able to get partially free and hopped to another portion of the room where Harr struck her again, the affidavit states.
He also used a black and white stun gun twice on her leg before Foor used it on her neck/throat, the victim said.
When other people began exiting the residence, Harr told the victim to leave but to not scream. The victim walked down the street to a friend, who called police, the report states.
Police noted electrical tape stuck to the victim’s boot and four red marks on her throat/neck area.
Police received a search warrant for the garage on the 2100 block of Breezewood Road, where they found a wooden chair, rope consistent to what the victim described and black electrical tape. Police also found two strands of used tape with suspected human hair.
During an interview with police, Harr claimed he and the victim got into a fight. He admitted to “bear hugging” the victim to control her and that he made a comment about tying her up, but denied that he restrained her.
Foor was subsequently interviewed and admitted to using a Taser on the victim on the throat and engaging in a physical altercation. She said the victim was tied to the chair for just “a second” and that Harr had taped the victim’s boots together so she couldn’t get up and run away, the report states.
After the victim got free of her restraints, Foor said they engaged in another physical fight, which is when she used the Taser on the victim. Foor also told officers that Harr performed a rear naked chokehold on the victim, but that the victim was only unconscious for a short amount of time.
Foor is scheduled for a preliminary hearing in front of Hetzel on Jan. 14.
Harr’s charges were bound to the Bedford County Court of Common Pleas following a preliminary hearing on Wednesday. Online court documents state that Harr’s $250,000 bail was revoked after he expressed an “unwillingness to comply with bail as indicated at a full bail hearing.”
