Altoona man’s kidnapping case heads to trial

HOLLIDAYSBURG — A city man accused of kidnapping a woman outside a Tyrone bar is heading to trial after his defense attorney asked on Monday for his case to be scheduled for jury selection.

Landon Robert Fagan, 22, appeared in Blair County Court alongside defense attorney Robert Donaldson for a trial list review hearing in front of President Judge Wade A. Kagarise to discuss the status of his case.

“This will be a trial,” Donaldson said.

He then asked for Fagan’s case to be scheduled for jury selection and Kagarise placed him on the list for Jan. 26. Kagarise said the selection would be handled by the judge assigned to Courtroom One on that day.

Fagan was taken into custody on May 4 after allegedly waiting outside DJ’s Cafe at 2068 Columbia Ave., Tyrone, for the victim to exit, according to the affidavit of probable cause.

A witness told officers that the victim left the cafe with three other individuals when Fagan pointed a gun in the group’s direction and forced the victim into his vehicle. Another witness said the car drove off with its passenger door half open.

During an interview with police, the victim told officers she escaped the vehicle at one point, but Fagan grabbed her by the hair and pushed her back into the car, the report stated.

She tried to escape again by hitting Fagan in the face, but Fagan hit her with a closed fist, possibly breaking her nose, court documents state.

The victim said Fagan stopped the vehicle at a Sheetz, so she ran inside and hid in the bathroom. She was then able to sneak out the gas station’s back door and run home, the report stated.

Fagan is facing a single felony count of kidnapping to inflict injury or terror, two misdemeanor counts of making terroristic threats, single misdemeanor counts of unlawful restraint resulting in serious bodily injury, stalking, false imprisonment, simple assault and recklessly endangering another person, as well as summary charges of harassment and disorderly conduct. He remains free after posting $50,000 bail.
