Ebensburg OKs zoning ordinance on business district uses

Regulation concerns business district commercial uses

Ebensburg Borough Council members granted final approval to zoning ordinance No. 675 during their meeting Monday night, Borough Manager Kelly Cook said.

The ordinance regulates the location and zoning of certain commercial uses — including gaming parlors, hookah bars, marijuana dispensaries, CBD stores, vape shops and tobacco stores — and prohibits these businesses from the borough’s central business district.

A public hearing was conducted Sept. 22 to solicit input about the ordinance.

During that hearing, council President Doug Tusing said the borough’s zoning ordinance, written about 2010, did not specifically list legal uses for gaming parlors, hookah bars, marijuana dispensaries, CBD stores, vape shops and tobacco stores.

It has been a long-term goal of borough officials to capitalize on the historic significance of the downtown area, Tusing noted during the hearing, adding a skills game business set up shop in the downtown and borough officials received a lot of negative feedback for allowing the business to exist.

That business will be grandfathered in under the new ordinance, borough Solicitor Matt Gribler said.

During Monday’s meeting, the council also hired Jerry Poruban as the borough’s public works director at a salary of $80,000, Cook said.

Poruban has served as the acting public works director since Aug. 5. He acted in that position with professionalism and a high degree of competency, according to the meeting’s agenda. Poruban recently passed the exam for a class E water license, according to the agenda.
