City man receives 6.5 years for possession of child porn

A city man who pleaded guilty to federal charges of possessing child pornography was sentenced Tuesday to 6.5 years in prison, followed by 20 years of supervised release.
With the federal sentencing complete, a Blair County sex assault case against Kevin Myers, 48, can proceed.
On May 19, 2022, in the U.S. District Court for the Western District of Pennsylvania, a three-count indictment was filed against Myers and he was taken into custody. The federal charges were for production and attempted production of material depicting the sexual exploitation of a minor, transportation and attempted transportation of material depicting the sexual exploitation of a minor and possession and attempted possession of material depicting the sexual exploitation of a minor.
According to court records, the incidents occurred from about December 2020 to about December 2021.
In November 2024, Myers pleaded guilty to Count Two, transporting and attempting to transport material depicting the sexual exploitation of a minor, and Count Three, possessing and attempting to possess material depicting the sexual exploitation of a minor.
Court documents state that in pleading guilty, Myers accepted his personal responsibility for transporting and possessing two electronic image files depicting a then-16-year-old female lying nude in the cabin of his tractor-trailer.
In a sentencing memorandum, acting U.S. attorney Troy Rivetti presented the facts in the case, stating that in the spring and summer of 2020, Myers, then 42 to 43 years old and an over-the-road truck driver, formed a relationship with a 15-year-old high school girl.
At some point, Myers began to have sex with the victim on a regular basis.
Then, due to the COVID-19 pandemic, when school was suspended, Myers began to take the girl with him in his semi-truck as he made deliveries up and down the eastern U.S.
During the trips, Myers would have sex with the girl, the memorandum states. It was during one of the trips to North Carolina in December 2020 that two photos were taken of the girl on Myers’ cellphone.
Myers “exploited a teenage girl. He manipulated her and used her to satisfy his physical impulses, leaving her robbed of her dignity,” the document states, adding that Myers knew better, as he was a middle-aged man in his second marriage.
Rivetti sought a sentence of 63 to 78 months.
Myers’ defense attorney Dan Kiss filed a memorandum and a request for a minimum sentence, stating that Myers had remained incarcerated since his arrest.
During his time behind bars in the Cambria County Prison, Myers has earned his GED, completed basic first aid training, completed a course on Adapting to Change and completed several cooking courses.
In addition, Myers worked in the food service department at the prison, working his way up the ranks from dishwasher to the special diets cook, preparing special diets for medical issued trays. He also helped train other workers in the food service department, stated a letter from Jeff Callihan, of the food service department at the prison.
Kiss also supplied character references from Myers’ brother and sisters, as well as from Myers’ wife.
All stated that they realized the charges are serious, but they believe Myers to be remorseful.
Blair County case
In Blair County, Myers faces sexual assault and related charges in a case that has been on hold pending the outcome of the federal case.
In December 2021, Altoona police charged Myers with rape, statutory sexual assault, unlawful contact with a minor, child pornography and related offenses based on the victim’s account of how Myers enticed her into sexual activity and raped her.
The girl told police that it started in mid-2020 when Myers sexually assaulted her inside his truck off the Pinecroft exit of I-99. She said it continued during the COVID-19 pandemic when she had no school and accompanied Myers on out-of-state deliveries.
According to online court documents, Myers faces 121 counts, including rape, statutory sexual assault, unlawful contact with a minor, child pornography, sexual assault, aggravated indecent assault, indecent assault, unlawful restraint of a minor, corruption of minors, stalking and kidnapping, among other charges.
Online court documents show the case is set for plea court on June 20 in Courtroom 1.
