Assault charge dismissed against assistant BG coach
A Johnstown magisterial district judge has dismissed a simple assault charge filed in October against a Bishop Guilfoyle Academy assistant girls basketball coach accused of slapping a player’s leg during a playoff game in February.
Judge Kevin J. Price of Johnstown dismissed the charge Thursday against Adam Kaack, 38, Altoona, after a preliminary hearing with testimony from the player, her father and a Johnstown police detective.
According to a story published Friday in the Tribune-Democrat, Price said in court that while he didn’t approve of Kaack’s actions, the case did not rise to the level of simple assault.
In support of the charge, a short video clip was presented in court, showing Kaack slapping the player on her thigh which was reported to have left a red mark.
When testifying Thursday, the player said she made a mistake during the game, prompting Kaack to yell at her and slap her thigh when he couldn’t control his anger, the Tribune Democrat reported.
The girl also testified that she did not seek medical attention because she was a starter and was “playing for the team,” the newspaper stated.
Ebensburg attorney Joseph Sutton, who represented Kaack, said the case offered no evidence that Kaack intended to commit harm and no evidence that he committed bodily injury through recklessness or negligence.
Kaack was also found not guilty of a summary harassment charge.
The Bishop Guilfoyle team was in Johnstown for the playoff game with Bishop McCort Catholic High School.
