A Martinsburg man is behind bars after police found him to be in possession of at least two baggies of suspected meth during a traffic stop early Monday morning.
Allen Lee Phelan Jr., 47, was arraigned by Magisterial District Judge Paula M. Aigner on one felony charge of deliver or possession with intent to deliver, one misdemeanor count each of tamper with/fabricate physical evidence, driving with a suspended license, use/possession of drug paraphernalia and intentional possession of a controlled substance by a person not regulated, as well as one summary charge each driving without a license and failure to stop at red signal, according to court documents.
Unable to post $100,000 bail, Phelan was remanded to the Blair County Prison. He is scheduled to appear in front of Magisterial District Judge Matthew Dunio for a preliminary hearing on April 11.
The charges stem from a traffic stop performed about 2:24 a.m. on April 1, when officers observed Phelan pull out from the I-99 exit ramp and turn left onto Frankstown Road while a green light was still showing for westbound traffic, according to the affidavit of probable cause. Officers then indicated for Phelan to pull over, and he stopped in the parking lot of Sheetz at 676 Frankstown Road.
Police records show that Phelan told officers he knew he was pulled over because he "ran that red light."
While speaking with Phelan, officers noted that "he was behaving nervous" and that he was "jittery, had accelerated speech, and did not provide the same story when questioned," according to the affidavit.
When officers ran Phelan's information through Blair 911, they received information that he had recently been arrested for possession with intent to deliver. Phelan was then instructed to exit the vehicle and officers observed a glass smoking device with burnt crystal residue on the driver seat, police documents show.
While searching Phelan, officers noticed that he was standing "with his legs very close together." When instructed to spread his legs, "a large corner cut baggie with suspected meth fell to the ground from his right pant leg," according to police reports.
Further searching revealed another baggie hidden in the groin area of Phelan's pants. The suspected meth weighed a combined estimated 69 grams, police documents show.
