HOLLIDAYSBURG -- An Altoona man who faces felony charges after a fatal drug overdose last year was scheduled to enter a plea agreement Thursday before Judge Wade Kagarise but had his case rescheduled.
Timothy Tombs, 50, has been charged with five felonies, including one count of drug delivery resulting in death, three counts of possession with intent to deliver a controlled substance and one count of criminal use of a communication facility.
He was also charged with three misdemeanor counts of possession of a controlled substance.
Tombs was arrested Oct. 17, 2022, at a rehabilitation facility in Cambria County on charges stemming from an investigation into a drug delivery that occurred in Altoona.
The investigation found Tombs delivered heroin on three separate occasions to the victim, with the final delivery resulting in the person's death.
His bail was set at $300,000. He is currently being housed in the Bedford County Correctional Facility.
In court Thursday, Assistant District Attorney Jonathan Thomas stated the details of Tombs' plea agreement, which he was about to enter.
Had he pled guilty, Tombs would have faced a sentence of six to 20 years in a state correctional facility. His misdemeanor charges would have been withdrawn, according to the plea bargain.
When Kagarise asked him whether he had sufficient time to discuss his charges with an attorney, Tombs said he did not. "I talked with (my attorney) for like maybe five minutes," he said.
"I don't want you to plead guilty if you think you haven't had enough time to understand what your options are," Kagarise said.
Tombs was rescheduled to appear before Kagarise at 8:30 a.m. Jan. 19 at the Blair County Courthouse.
