HOLLIDAYSBURG -- Another Blair County Prison inmate has pleaded guilty to aggravated assault and related charges for his role in a September 2022 beating of a fellow inmate.
Kyler Luckadoo, 22, Mount Union, is scheduled for sentencing on Jan. 11 before Judge Jackie Bernard, who ordered a presentence investigation that could factor into his jail time.
Defense attorney Dan Kiss told Bernard on Wednesday that Luckadoo was entering the open plea and rejecting the commonwealth's offer of 10 to 20 years' incarceration to follow whatever incarceration is handed down in Luckadoo's other criminal cases.
When Kiss asked Luckadoo to affirm his understanding that the judge could impose more or less time than the plea offer, Luckadoo said yes.
Kiss said he will be prepared at sentencing to offer arguments in favor of less.
"We don't have control, but we do have input," the defense attorney said.
First Assistant District Attorney Nichole Smith also advised Bernard that she will need time at sentencing to offer input from the victim, who underwent surgery to address his facial injuries and broken bones.
Smith also spoke of showing a prison video recording showing Luckadoo, along with John Allen Jukes, Delano Brown and Korey Sitton, going into the jail cell where the victim inmate was beaten.
The Sept. 15, 2022, video was shown during a May trial where testimony revealed that Richard Allen Ewing of Tyrone, who was running an illegal commissary, told Jukes to take an inmate's collection of commissary items.
The victim inmate testified that when he tried to intervene on behalf of his cellmate with the commissary items, the inmates assaulted him.
For their convictions associated with the assault, President Judge Elizabeth Doyle sentenced Ewing to 20 to 40 years' incarceration and Jukes to 18.5 to 37 years.
