Drafts offered for 2nd Amendment agreement

Webster presents proposed text to commissioners

HOLLIDAYSBURG — Blair County Commissioner Amy Webster presented a draft ordinance Tuesday that could make the county a Second Amendment Sanctuary, as voters directed by referendums in the November election.

Webster, who provided copies of the draft to fellow commissioners Bruce Erb and Laura Burke, also had additional copies available for distribution after the commissioners meeting.

The three-page draft ordinance, followed by an intergovernmental cooperation agreement, contains language that Webster said has been adopted by other governing bodies in Pennsylvania.

“I’m not saying we have to do this,” she said of the document. “I’m saying it’s a good first step.”

As written, the document references gun rights and three supportive U.S. Supreme Court rulings.

It also specifies that the ordinance does not apply to someone who is prohibited by law from owning or possessing a firearm, including those excluded because of criminal convictions.

The draft also includes a penalty, for violations, of $600 per day of violation plus prosecution costs and/or incarceration of not more than 10 days.

Commissioners Chairman Bruce Erb and fellow Commissioner Laura Burke accepted Webster’s draft ordinance and indicated that they will review it. Erb also spoke of his interest in solicitor Nathan Karn’s review of the draft.

Webster said the draft was developed after consultation with members of the Blair County Second Amendment Coalition, the Blair County Tea Party, the state’s Local Government Commission and the Firearm Owners of America.

Second Amendment Coalition President Bonita Shreve, who has been attending recent commissioners meetings looking for progress on the Second Amendment Sanctuary, told commissioners that U.S. gun rights remain in danger and deserve to be protected.

“The good citizens of Blair County are saying enough is enough,” Shreve said.

Frankstown Township resident Don Corl advised commissioners that he and some other Second Amendment referendum supporters are also working on a draft ordinance on behalf of the county. He said the group is reworking its earlier version and intends to submit it to the county for Karn’s review.

He also said he was aware of the draft proposal that Webster distributed Tuesday.

“We fully support any effort to help the Second Amendment movement in Blair County,” Corl said.
