No lawsuit against PSU’s Franklin, others

A lawsuit filed by a former Penn State team doctor against Nittany Lion coach James Franklin, two athletic directors and the university was dismissed Wednesday.

Dr. Scott Lynch missed the 180-day deadline by three days in filing a whistleblower suit alleging he was fired after reporting Franklin tried to meddle in medical decisions on when injured players could return to action.

The suit, which also named AD Sandy Barbour and Charmelle Green, an associate AD, needed to be filed by Aug. 20 but was not submitted until Aug. 23.

“The law is the law,” Dauphin County Judge Andrew H. Dowling wrote in his findings.

Lynch, who was replaced as PSU director of sports medicine by Dr. Wayne Sebastianelli, still has a suit pending against the Hershey Medical Center that Dowling did not dismiss.

Franklin and Penn State have denied Lynch’s claims.
