Two arrested in shooting at Altoona apartment building
Miles, Lindsey in jail after argument allegedly leads to victim being shot
A shooting Saturday evening left one man hospitalized and two others behind bars.
Garrett Ryan Miles, 40, and Jaice Vernon Lindsey, 41, are being housed in the Blair County Prison on $1 million bail each after a physical altercation on the fifth floor of the City Hall Commons ended with a male victim being shot in the torso.
The victim was taken to UPMC Altoona and transferred to UPMC Presbyterian in Pittsburgh for trauma treatment. According to court documents, the bullet entered the victim’s left side and was lodged in his spinal column, with severe hemorrhaging in his abdomen.
When police arrived at City Hall Commons shortly before 7 p.m., they found Miles and Lindsey tending to the victim, who was lying on the floor.
The victim was reporting no sensation or movement in his lower body, court documents state.
During the investigation, police learned that all three men were drinking heavily and watching college football games when an argument broke out.
Lindsey told police that Miles and the victim began verbally arguing and one of them ended up leaving. Shortly after, the other male left.
Lindsey reportedly heard a scuffling sound outside his apartment and then a loud pop.
He told police that he found Miles caring for the victim and that Miles said he shot him.
The original caller told police he was in his apartment when he heard people fighting in the hallway, verbally and physically. He then heard a loud bang, which he thought was someone being slammed into and shattering the elevator mirror. When the caller left his apartment, he saw Miles and Lindsey, along with the victim. Miles told the caller that he shot the victim; however, the caller told police he was not a direct witness to what happened.
Police were able to interview the victim before he was transferred to Pittsburgh.
The victim said both Miles and Lindsey began arguing with him while they were watching college football. The argument turned physical and in the area of the fifth-floor elevator lobby, both Miles and Lindsey began physically assaulting the victim in a “2-on-1” fashion, court documents state.
The victim said he was keeping up with both of them when Miles “went for the gun.”
The victim, when asked by police, said the gun was in Miles’ sweatpants pocket.
Police noted that in a prior, unrelated incident with Miles, he was patted down for weapons and the same Ruger LCP was found in his pocket.
In speaking with police, Miles said the gun was in his hoodie pocket and went off by accident. Police reported that no holes, tears or other damage was found on Miles’ clothing, which is inconsistent with the gun firing by accident.
In addition, when police recovered the gun, there was a live round in the chamber. Police reported that it is difficult for a semi-automatic handgun to fully cycle when hindered by clothing/material in close proximity.
Both Miles and Lindsey were taken into custody and arraigned Sunday before Magisterial District Judge Benjamin F. Jones.
Miles faces felony counts of conspiracy aggravated assault – injury with extreme indifference, conspiracy aggravated assault – with a deadly weapon, aggravated assault – extreme indifference and aggravated assault – deadly weapon, along with misdemeanor counts of possession of a weapon, recklessly endangering another person, conspiracy – recklessly endangering another person and simple assault. He also faces summary charges of harassment, disorderly conduct, public drunkenness and discharge of a firearm.
Lindsey was arraigned on similar charges in addition to possession of marijuana and possession of drug paraphernalia.
The two face preliminary hearings Dec. 17 before Magisterial District Judge Daniel C. DeAntonio.
