Victim, 16, alleges Moyer coerced her into sex multiple times

A New Paris man stands accused of raping a 16-year-old girl after a third party reported the incident to a Bedford County probation officer.

Dakota Brian Moyer, 19, was arraigned Wednesday by Magisterial District Judge Tonya M. Osman on single felony counts of rape, unlawful contact with a minor, sexual assault and corruption of minor. He was remanded to the Bedford County Correctional Facility in lieu of $500,000 bail.

An investigation into the allegations began on July 17 when state police at Bedford were notified by a Bedford County probation officer that Moyer had raped a 16-year-old female. The information was provided to the officer by a third party and state police believed the victim wasn’t aware the report was being made, according to the affidavit of probable cause.

When police interviewed the victim on July 30, she told officers she assumed it was “about what happened with Dakota.” After being asked about what happened, the victim said “it’s considered rape.” Through questioning, the victim told officers that Moyer would keep begging her for sex after she had already said no and “continued to say no” and “then I ended up just giving in.” She said the incidents occurred at Moyer’s residence along the 400 block of Dunnings Creek Road, West Saint Clair Township, Bedford County between April 1 and July 17, the police report states.

The victim said she and Moyer had engaged in sexual activity before but that many of those encounters were not consensual because Moyer would continue to guilt her into giving consent after being told “no” multiple times. She told officers the alleged rapes occurred as a result of coercion and emotional distress, the report states.

In an interview on Aug. 18, Moyer told officers that he believed he had done nothing wrong and that the rape allegations were made out of spite by other associates of his who also knew the victim, according to the affidavit.

Moyer is scheduled to appear in front of Osman on Nov. 12 for a preliminary hearing.
