Argument at hotel leads to arrest on firearm count
Cleveland man prohibited from possessing guns
A Cleveland, Ohio, man is behind bars after an argument at a local hotel led police to find he was in possession of a firearm.
Stephen Shawn Holbert, 54, was arraigned April 4 by Magisterial District Judge Matthew Dunio on one felony count of possession of a firearm prohibited and one misdemeanor count of possession of marijuana. Unable to post $50,000 bail, he was remanded to the Blair County Prison.
Altoona police responded about 1:12 p.m. April 4 to the Wingate Hotel, 909 Chestnut Ave., for a report of a man, later identified as Holbert, and a woman arguing in the lobby. Officers spoke with the woman outside, who said Holbert had driven her to Altoona from Ohio in her car to visit her brother at FCI Loretto, according to the affidavit of probable cause.
Officers located the woman’s car and confirmed through Blair 911 that it was registered in her name. The woman then told officers she and Holbert used ecstasy the night before and was afraid Holbert was “tripping out.” Officers looked for controlled substances through the windows of the woman’s car to be sure Holbert didn’t require medical assistance, court documents state.
While looking in the windows, officers saw ammunition in the driver’s side door. When asked if she owned a gun, the woman said no. Holbert told officers he didn’t own firearms because he wasn’t allowed to due to charges stemming from grand theft auto and burglary in Ohio, the police report states.
The woman consented to a search of the hotel room and her vehicle. While nothing was located in the hotel room, officers found a revolver-style handgun in its trunk with five spent rounds and two live loaded rounds, according to the affidavit.
When officers asked the woman about the gun, she said it belonged to Holbert. She said Holbert had told her about it before police arrived on scene about 12:30 p.m. and that he had access to her car while they’re at home.
Holbert was taken into custody and a search yielded one marijuana cigarette in his sweatpants pocket. Holbert’s criminal history confirmed he is a person not to possess firearms from a conviction of aggravated burglary in 1989, the complaint states.
Holbert is scheduled for a preliminary hearing in front of Dunio on April 16.
