Second person gets jail time in robbery

Figart pleads guilty to charges tied to assault in Brisbin home

CLEARFIELD — A former Brisbin woman accused of being involved in a robbery pleaded guilty to lesser charges Monday.

Kacy Rae Figart, 32, whose address is now listed as Curwensville, was sentenced by Clearfield County Judge Paul E. Cherry to serve three months to one year less one day in the county jail with two years’ consecutive probation for misdemeanor conspiracy/simple assault and recklessly endangering another person.

According to court documents, Figart and Cody Lynn Luzier, 38, lured the victim to their Brisbin home, then attacked and robbed him.

Her co-defendant, Luzier, was sentenced by President Judge Fredric J. Ammerman in August to serve 51 months to 8.5 years in state prison after he was convicted of aggravated assault and conspiracy.

In a separate case from 2024, Figart also pleaded guilty to driving under the influence, possession of a controlled substance and possession of drug paraphernalia. She was given an additional sentence of six months to one year in jail and two years’ concurrent probation for those charges.

For a third case, she must pay fines and costs for possession of a controlled substance and possession of drug paraphernalia charges.

Prior to sentencing, her attorney, Daniel Nelson, told the court she realized she had a problem and went to a rehabilitation program.

“She is not the same person,” Nelson said.

The original charges stem from an incident in November 2023 at a Brisbin residence.

According to the affidavit of probable cause, on Nov. 20, 2023, the victim contacted Figart, asking about the two getting together. She invited him to her home to visit her and another female friend.

The victim arrived at the home about 2 a.m. that night. They were in the living room for a while before Figart asked him to go back to the bedroom to look at her water bong, police said.

As he walked back toward the bedroom, he was reportedly attacked by Luzier, who struck him in the head multiple times with a metal object.

The victim told authorities he fell to the floor and Luzier jumped on top of him. Luzier then began to choke and threatened to kill him, according to police records.

The victim was able to get away from Luzier and sought treatment at Penn Highlands Clearfield, according to court records.

Luzier was accused of taking $415 and a Bluetooth speaker from the man.

During the trial, Luzier testified in his defense, saying he did not rob the victim, but admitted to getting angry and fighting with him.
