Many employers attempt to ensure those responding to "help wanted" advertisements have at least basic knowledge and some background in good work habits. A way of doing that is to limit applicants to those with high school diplomas.
But the U.S. Equal Employment Opportunity Commission now said requiring job applicants to have high school diplomas may be illegal. Why? Because, according to the EEOC, it could screen out applicants who, because of disability, were unable to graduate from high school.
To continue using the requirement, employers may have to prove to the EEOC that high school diplomas are "job-related for the position in question and consistent with business necessity."
Amazing. As one critic of the proposed rule has pointed out, its enforcement would be an incentive for some young people to drop out of high school. Why work that hard if diplomas cannot legally be required?
The EEOC under President Barack Obama has issued many rules that appear intended solely to make it more difficult to create new jobs in America - but this one may represent a new low.
