Federal prisoner testifies at Clark trial

POSTED: June 25, 2008

BEDFORD -- Federal prisoner David Lucas, who is serving 34-plus years at the U.S. Penitentiary at Lewisburg for armed bank robberies, testified this morning in Bedford County Court during the Joseph W. Clark retrial.

Clark is on trial for the April 30, 2000, kidnapping and murder of Holly Notestine of Clearville.

Lucas testified that in July 2005 he contacted defense attorney Thomas Crawford, saying he wanted to confess to Notestine's murder. In the handwritten statement Crawford wrote when he met with Lucas in August 2005, Lucas gave vague details about meeting a woman at a convenience store and following her.

This morning, he was on the stand for about one hour. He testified that he was in Bedford County on April 30, 2000, stole a car from a residence, then drove it to a convenience store where a woman belittled him and made him angry. He said he followed her to what appeared to be a farm, watched her and waited until a man there left.

While he pleaded the Fifth Amendment on anything related to murder, he testified that he returned the car to the residence from where he had stolen it and then set it on fire.

Lucas also testified in Clark's first trial earlier this year but pleaded the Fifth to nearly every question he was asked.

Defense testimony continues this morning.

LUCAS: "...But sir, what do I say when they ask me somethin I don't know nuttin' 'bout? I didn't do it, ya know".

ATTORNEY: "That's ok. If you don't know the answer to a particular question, simply plead the fifth".

LUCAS: "yes sir; I kin sure enough to that, sir!"

ATTORNEY: "So Mr. Lucas. Can you describe the driveway entrance into the home? Was it dirt, gravel, pavement, blacktop? Were there trees, bushes or anything that sticks out in your mind"?

LUCAS: "Judge, Sir; the Attorney told me if I didn't know, to Plead the Fifth. So, Judge, Sir, I'm pleadin' for a fifth of Jack Daniels"

ATTORNEY: "Dumbass!"

If you steal a car from someone and commit a kidnapping/murder in it, why would you then drive the car back to the person's property you stole it from and then set it on fire? This guy's story doesn't add up.

How much was this guy paid for trying to ensure reasonable doubt? If anyone believed this I'd say they were crack heads.
