DiGiacobbe allegedly said he’d throw child

ROARING SPRING — An argument in Roaring Spring has led to charges against a man after witnesses told police he allegedly threatened to throw a newborn onto the road.

Michael D. DiGiacobbe, 29, of East Freedom, is accused of making the threat while holding a carrier seat with the newborn during an argument with the baby’s mother.

DiGiacobbe, the baby’s mother and two others were at an East Main Street residence in Roaring Spring about 1 p.m. April 17. According to charges filed by Roaring Spring police, the baby’s mother became upset after she found messages from other women on DiGiacobbe’s phone and, after taking his phone to her vehicle, she walked back inside to collect keys and the baby.

DiGiacobbe allegedly grabbed the baby in the car seat and demanded his phone after he realized it was missing.

Police said the argument continued outside with DiGiacobbe throwing items around the car and ultimately making the threat to throw the car seat and baby onto the road.

He was eventually talked into handing the baby over to the mother, and as she was about to leave with the baby, DiGiacobbe allegedly told her she better have the child back by a certain time or he would “assassinate” her and her family, police wrote in the charges.

The next day the couple argued again and DiGiacobbe allegedly threatened to kill some kittens at the East Main Street location. Police said the woman sought and was granted an emergency protection-from-abuse order after she reported it to the police on Friday.

DiGiacobbe is charged with two counts each of misdemeanor endangering the welfare of a child, terroristic threats and harassment. He was released Friday after his arraignment and is scheduled to appear at Martinsburg Central Court on May 2 for a preliminary hearing.
